The application of constitutional and conventional rules in the use of pretrial detention in Ecuador

Introduction: The International Financial Reporting Standard (IFRS) 3 Introduction: In criminal matters the presumption of innocence is a fundamental right for the protection of people's liberty, however, this has been frequently violated; consequently, many people have been deprived of their liberty without sufficient elements of conviction. Objective: The objective of this article is to determine, through a case study, if the administrators of justice applied constitutional and conventional norms when establishing pretrial detention to verify if there was no restriction of rights. Methods: This research has a qualitative approach with a non-experimental design, a legal, doctrinal and jurisprudential study of the constitutional and conventional norms and of pretrial detention was carried out; in addition to the analysis of a case study, contrasting with the opinions of experts in the area of Criminal and Constitutional Law. Results: The case study analyzed is controversial and it is identified that although due process was carried out if there was restriction of rights, noting that the requirements of suitability, necessity and proportionality are not met to dictate pretrial detention, in the case analyzed and in general this measure is often applied arbitrarily. Conclusions: The right to the presumption of innocence is fundamental for the protection of people's freedom and to ensure that only the guilty are punished. However, in many countries around the world, pretrial detention has been abused as a precautionary measure, which has led to a disproportionate increase in the number of people deprived of liberty and has affected the constitutional rights of individuals, such as the right to liberty and the presumption of innocence.
