Projection of the referendum in Ecuador: a mechanism of consultative political control or an instrument of political manipulation?

This research demonstrates the problems in Ecuador with the democratic mechanisms of direct participation of the referendum and the popular consultation, which have not allowed for the full exercise of the right to citizen participation established in the Constitution, in addition to the lack of social control. The role of each referendum and the extent of political manipulation at the service of the government in power are discussed. Non-experimental and longitudinal research design declared the dogmatic method ascribed to positive law, and, of the scientific research methods, the historical method, exegetical method. Doctrine, norms, and jurisprudence are assumed as formal sources. The results of each referendum framed in the historical context, demonstrate the extent of its management by the different governments, from the 19th century onwards, and the gradual acquisition of political culture by the Ecuadorian citizens. The conclusion is that it is necessary to interpret the referendum phenomenon according to the historical context, and to go beyond the legal paradigm, where the democratic consultative mechanism has been applied in periods of need for change, but in most cases, it has been disguised as political interests in accordance with the objectives of the governments. For this reason, it is necessary to contribute to the history of Ecuadorian law from multiple perspectives.
