Special Positive Prevention of the Penitentiary System in Ecuador for the period 2019 – 2022

This research shows the current condition of the Ecuadorian prison system in terms of positive special prevention, and the connection between the penal constitution and the necessary theoretical justification for criminal punishment of those who choose to ignore the law. Also, the possible role of positive special prevention in Ecuador, and how the mismanagement of this tool by the Ecuadorian government has resulted in negative responses to the control, rehabilitation and reintegration of persons deprived of liberty into society. The objective of this research is to analyze the penal constitution, from a political-criminal vision, the role of special prevention and the need to establish new strategies for crime prevention, presenting a discussion on the functions that this change can fulfill from the perspective of the penal constitution, and the change in violence and crime statistics improving the current crisis in Ecuador.
