Introduction: Every person has the right to enjoy work of their free choice under equitable and satisfactory conditions. Labor relationships are finite and can end in different ways, one of which is dismissal and approval, both in accordance with Ecuadorian legislation. They have their procedures
Objective: Analyze situations of ineffective dismissal and violation of rights when a worker terminates the employment relationship with approval.
Method: We worked under the qualitative paradigm, a documentary review process was followed. For the analysis of the information, documentary observation and summary presentation techniques were used as starting points.
Results: When a worker terminates his employment relationship through approval, the employer must reinsert him again, without this meaning a break in his working time and any pending remuneration must be cancelled, unless the affected person make the decision not to continue with the relationship, in this case you must receive compensation in accordance with the provisions of Ecuadorian legislation. The discussion appeals to respect for the rights of the worker, violated by an ineffective dismissal.
Conclusions: The State of Ecuador has been advancing in this matter with special attention to the pursuit of guarantees for all workers, but in particular for women who fulfill not only their role as workers but also as mothers, wives and sometimes heads of families. family.
